Domain Name Registration Terms

These Domain Name Registration Terms apply where Coen Jacobus Voskuilen, trading as FoxWise, registers, renews, transfers or manages a domain name on behalf of a client.

They form part of the terms applicable to any domain name registration or management service provided by FoxWise.

1. Identification of the Sponsoring Registrar and Reseller Status

The registration of domain names under generic top-level domains (gTLDs) is carried out by the ICANN-accredited registrar:

Soluciones Corporativas IP, an accredited registrar of the Internet Corporation for Assigned Names and Numbers (ICANN).

Coen Jacobus Voskuilen, trading as Foxwise, acts solely as a reseller of the services provided by the accredited registrar and is not itself an ICANN-accredited registrar.

2. Application of ICANN Policies

The domain name holder acknowledges and agrees that the registration, renewal, transfer and deletion of domain names are subject to the policies established by ICANN, including its Consensus Policies, as well as the specific policies applicable to each domain extension.

The domain name holder agrees to comply with these policies and with any future amendments adopted by ICANN.

The domain name holder acknowledges and agrees to the applicable provisions of the ICANN Registrar Accreditation Agreement, which forms part of the terms applicable to domain name registration services provided through FoxWise.

3. Registrant Information

The domain name holder agrees to provide truthful, accurate and up-to-date information, including:

The domain name holder is responsible for keeping this information up to date throughout the registration period.

Providing false, inaccurate or outdated information constitutes a breach of these terms and applicable ICANN policies and may result in suspension or cancellation of the domain name by the accredited registrar, following notification to the email address provided by the domain name holder.

4. Obligations of the Domain Name Holder

The domain name holder represents and warrants that:

  1. Registration of the domain name does not infringe the rights of any third party.
  2. The domain name will not be used for unlawful purposes.
  3. Use of the domain name complies with applicable law and with the policies of ICANN and the relevant registry.
  4. The domain name will not be used for spam, phishing, malware distribution, botnets, identity theft or any other abusive activity as defined by ICANN policies and the accredited registrar’s anti-abuse policy.

The domain name holder is solely responsible for the use made of the domain name.

5. Dispute Resolution Procedures

The domain name holder agrees that disputes concerning the registration of a domain name may be subject to dispute resolution procedures established by ICANN, including:

6. Domain Name Transfers

Transfers between registrars are governed by ICANN’s Transfer Policy and the procedures established by the accredited registrar.

The domain name holder acknowledges that certain transfers may require additional confirmation or identity verification.

The domain name holder has the right to obtain the authorisation code (AuthInfo/EPP code) required to initiate a transfer to another registrar.

Coen Jacobus Voskuilen, trading as Foxwise will provide this code at the request of the domain name holder, in accordance with ICANN’s Transfer Policy and within the applicable time limits.

The domain name holder may request that the domain be locked or unlocked (“registrar lock”). A registrar lock helps prevent unauthorised transfers; unlocking the domain is normally required before an outgoing transfer can be initiated.

7. Expiration and Deletion of Domain Names

If a domain name expires, the procedures and time periods established by ICANN and the relevant registry will apply.

The domain name holder is informed that a Redemption Grace Period may apply following expiration. During this period, the domain name may be recoverable subject to payment of the applicable fees.

Once the applicable grace periods have ended, the domain name may become available for registration by third parties without any preferential recovery right for the former domain name holder.

8. Limitation of Liability

To the extent permitted by applicable law, neither the accredited registrar nor the reseller shall be liable for indirect, incidental or consequential damages arising from the registration, use, transfer or cancellation of a domain name.

This limitation may not apply where the domain name holder qualifies as a consumer under applicable consumer protection legislation.

9. Notifications

Notifications concerning the domain name, including expiration notices, dispute procedures, requests for verification of registrant information and actions taken by the accredited registrar, will be sent to the email address provided by the domain name holder.

The domain name holder is responsible for keeping this email address active and for updating their contact information following any change.

10. Precedence of ICANN and Registry Policies

In the event of any conflict between these terms and mandatory policies established by ICANN or the relevant registry, those mandatory policies shall prevail.
